This page applies to the free Fenestry account. It contains the information we must give you before you create an account, how the contract comes about, your right of withdrawal and a model withdrawal form. We also send you this text by e-mail when you create your account.

2. What you get

Fenestry compares prices of rare climbing aroids from public shop catalogues and seller listings. We do not sell plants; any purchase is a contract between you and the shop, on the shop's terms. Prices and stock are taken from the shops and can be out of date or wrong.

3. Price

The account is free: you pay no money. You provide your e-mail address and your watch settings. We use them to provide the account and alerts; we also use the watch settings, counted anonymously, for demand statistics (privacy notice, section 6.8), and your e-mail address for offers of our own similar services unless you object (section 6.9 of the privacy notice). There are no further costs apart from the usual costs of your internet connection.

4. Duration and ending the contract

The contract runs for an indefinite period. You can end it at any time with "Delete my account" in your account or by e-mail to us. If you do not use your account for 24 months, we send you a warning; if you do not sign in within 30 days after it, we delete the account and the contract ends.

5. How the contract comes about

  1. You enter your e-mail address in "Watch" or "Sign in" and choose "Send code". Before that you can tick price alerts and news.
  2. We send you an e-mail with a 6-digit code and a sign-in link. This e-mail confirms that we have received your request.
  3. You enter the code or open the link. With this first sign-in your account is created and the contract is concluded.

Correcting mistakes: until you choose "Send code" you can change everything you entered. If you entered a wrong e-mail address, no code reaches you; simply request a new code with the right address. We do not store a separate contract text; the terms are this page and the privacy notice, which you can save or print, and we send them to you by e-mail. The contract language is English. We have not signed up to any code of conduct.

6. Technical requirements

Fenestry runs in an up-to-date web browser with JavaScript; you need an e-mail address. Nothing needs to be installed. Staying signed in uses a session cookie (privacy notice, section 6.2). There are no technical protection measures. We update Fenestry continuously for as long as we offer it.

7. Your statutory rights

The statutory rights for digital services apply (sections 327 to 327u of the German Civil Code, BGB), including your rights if the service is not in conformity with the contract.

Disputes: we do not take part in dispute resolution proceedings before a consumer arbitration board and are not obliged to.

8. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Yanick Süttmann, c/o Studio Sonsu GbR, Teichstraße 2, 30449 Hannover, Germany, telephone +49 511 41066098, e-mail contact@fenestry.app) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at fenestry.app/watch/ (button "Withdraw from contract here" in your account). If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

What this means for the free account: you have paid nothing, so there is nothing to reimburse. If you withdraw, we delete your account, your watches and your settings as with "Delete my account"; only the record that proves your consents remains (privacy notice, section 6.5), and, if you objected to offers, the entry on the objection list (section 6.9). Withdrawing has no other consequences for you.

You can also withdraw online after signing in to your account: use "Withdraw from contract here" there and confirm with "Confirm withdrawal". The link "Withdraw from contract" at the bottom of every page leads there (fenestry.app/watch/#widerruf).

2. Was Sie bekommen

Fenestry vergleicht Preise seltener Kletteraroiden aus öffentlichen Shopkatalogen und Verkaufsanzeigen. Wir verkaufen keine Pflanzen; ein Kauf ist ein Vertrag zwischen Ihnen und dem Shop, zu dessen Bedingungen. Preise und Bestand übernehmen wir von den Shops; sie können veraltet oder falsch sein.

3. Preis

Das Konto ist kostenlos: Sie zahlen kein Geld. Sie stellen uns Ihre E-Mail-Adresse und Ihre Watch-Einstellungen bereit. Wir nutzen sie für Konto und Alarme; die Watch-Einstellungen nutzen wir außerdem, anonym gezählt, für eine Nachfragestatistik (Datenschutzerklärung, Abschnitt 6.8), und Ihre E-Mail-Adresse für Angebote unserer eigenen ähnlichen Dienste, solange Sie nicht widersprechen (Abschnitt 6.9 der Datenschutzerklärung). Weitere Kosten entstehen nicht, außer den üblichen Kosten Ihrer Internetverbindung.

4. Laufzeit und Beendigung

Der Vertrag läuft auf unbestimmte Zeit. Sie können ihn jederzeit beenden, mit „Delete my account“ in Ihrem Konto oder per E-Mail an uns. Nutzen Sie Ihr Konto 24 Monate lang nicht, schicken wir Ihnen eine Vorwarnung; melden Sie sich in den 30 Tagen danach nicht an, löschen wir das Konto, und der Vertrag endet.

5. Wie der Vertrag zustande kommt

  1. Sie geben unter „Watch“ oder „Sign in“ Ihre E-Mail-Adresse ein und wählen „Send code“. Vorher können Sie Preisalarme und Neuigkeiten ankreuzen.
  2. Wir senden Ihnen eine E-Mail mit einem sechsstelligen Code und einem Anmeldelink. Diese E-Mail bestätigt, dass Ihre Anfrage bei uns eingegangen ist.
  3. Sie geben den Code ein oder öffnen den Link. Mit dieser ersten Anmeldung entsteht Ihr Konto, und der Vertrag ist geschlossen.

Eingabefehler berichtigen: Bis Sie „Send code“ wählen, können Sie alle Eingaben ändern. Haben Sie eine falsche E-Mail-Adresse eingegeben, erreicht Sie kein Code; fordern Sie einfach einen neuen Code mit der richtigen Adresse an. Einen gesonderten Vertragstext speichern wir nicht; die Bedingungen sind diese Seite und die Datenschutzerklärung, die Sie speichern oder ausdrucken können, und wir senden sie Ihnen per E-Mail. Vertragssprache ist Englisch. Verhaltenskodizes haben wir uns nicht unterworfen.

6. Technische Voraussetzungen

Fenestry läuft in einem aktuellen Webbrowser mit JavaScript; Sie brauchen eine E-Mail-Adresse. Installiert werden muss nichts. Für das Angemeldetbleiben dient ein Sitzungs-Cookie (Datenschutzerklärung, Abschnitt 6.2). Technische Schutzmaßnahmen gibt es nicht. Wir aktualisieren Fenestry laufend, solange wir es anbieten.

7. Ihre gesetzlichen Rechte

Es gelten die gesetzlichen Rechte für digitale Dienstleistungen (§§ 327 bis 327u BGB), einschließlich Ihrer Rechte, wenn die Leistung nicht vertragsgemäß ist.

Streitbeilegung: An Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle nehmen wir nicht teil und sind dazu nicht verpflichtet.

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.

Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Yanick Süttmann, c/o Studio Sonsu GbR, Teichstraße 2, 30449 Hannover, Telefon +49 511 41066098, E-Mail contact@fenestry.app) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Sie können Ihr Widerrufsrecht auch online unter fenestry.app/watch/ (Schaltfläche „Withdraw from contract here“ in Ihrem Konto) ausüben. Wenn Sie diese Online-Funktion nutzen, übermitteln wir Ihnen auf einem dauerhaften Datenträger (z. B. durch eine E-Mail) unverzüglich eine Eingangsbestätigung mit Informationen zum Inhalt der Widerrufserklärung sowie dem Datum und der Uhrzeit ihres Eingangs.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

Was das für das kostenlose Konto heißt: Sie haben nichts bezahlt, also gibt es nichts zurückzuzahlen. Widerrufen Sie, löschen wir Ihr Konto, Ihre Watches und Ihre Einstellungen wie bei „Delete my account“; es bleibt nur der Nachweis Ihrer Einwilligungen (Datenschutzerklärung, Abschnitt 6.5) und, falls Sie Angeboten widersprochen haben, der Eintrag in der Widerspruchsliste (Abschnitt 6.9). Weitere Folgen hat der Widerruf für Sie nicht.

Sie können auch online nach Anmeldung in Ihrem Konto widerrufen: dort über die Schaltfläche „Withdraw from contract here“ und die Bestätigung „Confirm withdrawal“. Dorthin führt der Link „Withdraw from contract“ unten auf jeder Seite, im deutschen Teil der Rechtsseiten „Vertrag widerrufen“ (fenestry.app/watch/#widerruf).
